I.  What is the New Type of Visa, Status or Eligibility?

Immigration Control and Refugee Recognition Act,"ICRRA"「出入国管理及び難民認定法」has been revised effectively as of April 1st, 2019 to make a new type of visas "Specified Skilled Worker"「特定技能」which has two sub-types (i)&(ii)「1号&2号」 .

"Specified Skilled Worker" is a working visa which has been enacted for compensating lack of labors in the Japanese market.

ICRRA regulated the admitted activities for "Specified Skilled Worker" as follows:

"Specified Skilled Worker"(i)

activities of business under designated contracts with domestic public or private institution by the minister of justice in accordance with "clause 1 to 4, article 2-5" of ICRRA, in designated field of industries as a field with difficulty of recruitment by the minister of justice requiring skills which are also need considerable knowledge  or experiences specified by regulations also appointed by the minister of justice

Fourteen fields are currently designated as follows:

Nursing Care, Cleaning of Building, Raw Materials & Shapes, Manufacturing of Industrial Machines, Electric & Electronic Information, Construction, Shipbuilding & Shipboard, Maintenance of Automobiles, Airline, Hotel & Lodge, Agriculture, Fishery, Manufacturing of Beverages, Food Service

"Designated Skilled Labor"(i) visas can be obtained by people from nine countries, Vietnam, Philippines, Cambodia, People's Republic of China, Indonesia, Thailand, Myanmar, Nepal & Mongolia.

"Specified Skilled Worker"(ii)

activities of business under the designated contracts with domestic public or private institution by the minister of justice in accordance with "clause 1 to 4, article 2-5" of ICRRA, in the designated field of industries as a field with difficulty of recruitment by the minister of justice, requiring experienced skills specified by regulations also appointed by the minister of justice

Two fields are currently designated as follows:

Construction, Shipbuilding & Shipboard

II. What Kinds of Ability is Required to Get "Specified Skilled Worker" Visa?

"Specified Skilled Worker"(i)

Ability in understanding Japanese should be certified by an examination or another method of evaluation.

Ability of skills required for labor to be applied for should be certified by an examination or another method of evaluation.

If the applicant has completed training of "Technical Intern Training"(ii), it is not required to certify ability of Japanese or skills. 

"Specified Skilled Worker(ii)

Ability of skills required for labor to be applied for should be certified by an examination or another method of evaluation.

Ability in understanding Japanese shall not required to be certified.

III.  How long Can it be Admitted to Stay in Japan under "Specified Skilled Worker"?

"Specified Skilled Worker"(i)

1 year, 6 months or 4 months

It is prohibited to be extended beyond five years in total. 

"Specified Skilled Worker(ii)

3 years, 1 years, or 6 months

There is no restriction on maximum terms of a stay.

IV.  Is it Allowed to Live with the Family?

"Specified Skilled Worker"(i)

It is not permitted to live with the family in Japan.

"Specified Skilled Worker(ii)

It might be permitted to live with the spouse, the son or the daughter in Japan, if the conditions have been met.

V.  In Which Field of Industries can it be Allowed to Work?

"Specified Skilled Worker"(i)

Nursing Care, Cleaning of Building, Raw Materials & Shapes, Manufacturing of Industrial Machines, Electric & Electronic Information, Construction, Shipbuilding & Shipboard, Maintenance of Automobiles, Airline, Hotel & Lodge, Agriculture, Fishery, Manufacturing of Beverages, Food Service

Construction, Shipbuilding & Shipboard

VI.  What Kinds of Regulations are Made on the Accepting Company?

A. Contract of Employment

The contract between a worker under a "Specified Skilled Worker" visa and an accepting company should correspond to standards regulated by the ministry of justice which should require the same level of wages as Japanese workers, treatments for departure of the worker after its stay and security  of convenient life of the worker.

B. Support Plan

An accepting company should make and execute a support plan for a worker under "Designated Skilled Labor"(i) visa, which shall make the worker can make its working life, daily life and social life comfortable. 

C. Registered Supporting Institution

An accepting company can outsource all or part of supporting services for worker under  "Specified Skilled Worker"(i) visa to third parties. 

If an accepting company outsources all of its supporting services to a registered supporting institution, the accepting company can shall recognizer to fulfill its duties of executing support plans for workers under "Specified Skilled Worker"(i) visa.

VII. Memorandum of Cooperation between a Designated Country and Japan

Govenment of Japan has entered into several memorandums of cooperation with the designated countries to send worker with "Specified Skilled Worker" visas.

Under these memorandums, an employment system on "Specified Skilled Worke" visa for each country has been constructed.

For example, if a citizen of Indonesia living in Indonesia want to seek a job in Japan with a "Specified Skilled Worker" visa, she or he at first need to register in a website system called "IPKAL".

Employers in Japan also need to register in IPKAL, if they want employ Indonesian workers with "Specified Skilled Worker" visas.
